Wa'alaykumussalam, To
ɗan'uwa wannan abin da

amma idan akwai ruwa a ciki, to malamai sun yi saɓani akan hakan zuwa maganganu guda
biyu:
1. Ya halatta su
agonce, saboda kasancewar nonon da yake haramta aure shi ne wanda aka sha kafin
yaro ya cika shakaru biyu, saboda fadin Annabi Sallallahu Alaihi Wasallam
“Shayarwar da take haramtawa, ita ce wacce yaro ya sha saboda yunwa” , Bukhari
lamba ta: 5102, ma’ana lokacin da ba zai iya wadatuwa ba daga nono, saboda shi
ne abincinsa, shi kuma wannan ya faru ne bayan mutum ya girma don haka ba zai
yi tasiri ba wajan haramta aure, wannan ita ce maganar mafi yawan malamai.
2. Yana haramta aure,
saboda ko da yaushe mutum ya sha nonon mace to ta haramta a gare shi, domin
Annabi Sallallahu Alaihi Wasallam ya umarci matar Abu-huzaifa da ta shayar da
Salim, don ta haramta a gare shi, kamar yadda Muslim ya rawaito a hadisi mai lamba
ta: 2636, tare da cewa a lokacin Salim ya riga ya girma, wannan sai yake nuna
cewa idan babba ya sha nono to zai yi tasiri wajan haramcin aure.
Zancen da ya fi karfi
shi ne nonon da mutum ya sha bayan ya girma ba ya haramta aure a tsakaninsa da
matar da ta ba shi.

ƘARIN BAYANI
HUKUNCIN AUREN
SAURAYIN DA YA TSOTSI NONON BUDURWARSA
TAMBAYA:
Assalamu alaikum. Akwai wani
saurayi da budurwa da suka tsinci kansu a cikin wani babban kuskure har
saurayin ya tsotsi nonon budurwar, kuma har ruwa (nono) ya fito ya sha. Shin
wannan ya haramta musu aure a matsayin "uwa da ɗa" na shayarwa? Kuma mene ne hukuncin
wannan aikin da suka yi a shari'ance?
AMSA:
Abu na farko da ya kamata a sani
shi ne: abin da saurayin nan ya yi haramun ne kuma babban laifi ne a shari'a.
Allah Madaukakin Sarki ya haramta taɓa
jikin macen da ba muharramarka ba, balle har a kai ga irin wannan mu'amala ta
sha'awa. Wajibi ne su tuba zuwa ga Allah tare da yin nadama.
Game da hukuncin aurensu, akwai
maganganu guda biyu na malamai, amma ga bayanin da ya fi inganci:
1. Magana Mafi Inganci (Ba Ya
Haramta Aure): Mafi yawan malamai (Jamhurul Ulama), ciki har da mazhabar
Malikiya, Shafi'iyya, da Hanbaliya, sun tafi akan cewa shayarwar da take
haramta aure ita ce wacce ta faru lokacin da yaro yake ƙarami (kafin ya cika
shekaru biyu na haihuwa).
Duk wani nono da mutum ya sha
bayan ya girma, ba ya sanya shi ya zama ɗan
matar da ta shayar da shi. Saboda haka, auren wannan saurayi da budurwar ya
halatta, kuma ba su zama uwa da ɗa
ba.
2. Hukuncin Shan Ruwan (Nono):
Shan nonon mace ga namijin da ya girma ba ya haramta aure, amma kuma ba a so
mutum ya sha idan ba ta hanyar lalura ba (misali magani ga wasu malaman). Sai
dai idan hakan ta faru lokacin wasannin ma'aurata (miji da mata), to babu laifi
kuma ba ya haramta aurensu. Amma ga saurayi da budurwa, asalin aikin baki ɗayansa haramun ne.

HADISI NA ƊAYA (AKAN LOKACIN
SHAYARWA):
النَّصُّ النَّبَوِيُّ: عَنْ عَائِشَةَ رَضِيَ
اللَّهُ عَنْهَا قَالَتْ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:
"لَا تُحَرِّمُ الْمَصَّةُ وَلَا الْمَصَّتَانِ." (رواه مسلم)

A'isha (RA) ta ce: Manzon Allah (SAW) ya ce: "Tsotso ɗaya ko tsotso biyu ba ya
haramta aure (sai an kai biyar masu gamsarwa a wasu ruwayoyin)."
HADISI NA BIYU (AKAN SHEKARUN
SHAYARWA):
النَّصُّ النَّبَوِيُّ: عَنْ أُمِّ سَلَمَةَ رَضِيَ اللَّهُ عَنْهَا
قَالَتْ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "لَا يُحَرِّمُ
مِنَ الرَّضَاعَةِ إِلَّا مَا فَتَقَ الْأَمْعَاءَ فِي الثَّدْيِ، وَكَانَ قَبْلَ الْفِطَامِ."
(رواه الترمذي وصححه)

Ummu Salama (RA) ta ce: Manzon Allah (SAW) ya ce: "Babu abin da yake
haramtawa na shayarwa face abin da ya buɗe
hanji (ya zama abinci) ta hanyar nono, kuma ya kasance kafin yaye (kafin
shekaru biyu)."
Sharhi: Wannan hadisi ya yanke
magana cewa dole ne shayarwar ta kasance lokacin da yaro yake jariri wanda yake
rayuwa da nonon. Shi kuma wannan saurayi ya riga ya girma, don haka nonon ba
zai gina jikinsa ba yadda za a ce ya zama ɗan
matar.
MAGANA AKAN HADISIN SALIM (MAULAH
ABU HUZAIFA):
Wasu suna kafa hujja da hadisin
da Annabi (SAW) ya ce wa matar Abu Huzaifa ta shayar da Salim (wanda ya girma)
domin ya zama muharraminta. Amma malamai sun ce wannan keɓantaccen hukunci ne
(Khususiyyah) ga Salim kawai saboda wata lalura ta daban, ba zai zama doka ga
kowa ba. Shari'ar Musulunci tana kan cewa shayarwa tana haramtawa ne kawai
kafin yaye.
Kammalawa:
1. Aure: Ya halatta su auri juna
matuƙar
ba su da wata alaƙar jini ko ta shayarwa tun suna jarirai.
2. Tuba: Dole ne su tuba su daina
keɓancewa da juna
(Khalwa) har sai lokacin da za su yi aure.
3. Hukunci: Wannan aikin da suka
yi (tsotson nono) laifi ne na keta alfarmar shari'a, amma ba ya sanya su zama
uwa da ɗa.
