HUKUNCIN NAMIJI YA SUMBANCI (KISS) ƊAN'UWANSA NAMIJI

Wa alaikumus salam wa
rahmatullahi wa barakatuhu.
Bai halatta ga mutum
namiji ya sumbanci ɗan'uwansa namiji ba,
musamman idan sumbantar akan bakinsa ne. Hakanan bai halatta ga mace ta aikata
irin hakan ga 'yar'uwarta mace ba, Saboda miyagun haramtattun abubuwan da yin
hakan zai iya haifarwa misali kamar luwaɗi, madigo, da sauransu.
Hakanan ya zo a cikin
fatawoyin Imamu Ahmad bn Hanbal da shahararren Malamin nan Ibnul Muflih cewa
mafiya rinjayen Malamai sun karhanta yin sumba (KISS) akan kumatu a tsakanin

ZAREE'AH' (wato haramtawa ko karhanta wasu abubuwa domin toshe kofar da ɓarna ke iya shigowa
cikin al'ummah).
Shi ya sa addinin
musulunci ya haramta kebancewa tsakanin mace da duk wani namijin da ba
muharraminta ba, kuma ya haramta mazaje biyu ko mataye biyu su lulluba da maya
fi guda akan shimfida guda. Ina fatan ka fahimta.

ƘARIN BAYANI

Assalamu Alaikum malam, ina fatan
kana lafiya. Tambayata ita ce: mene ne hukuncin shari’a idan namiji ya sumbanci
ɗan’uwansa namiji,
wato a cikin yanayin jinsi ɗaya?
Shin wannan halal ne ko haram? Kuma idan akwai wasu dalilai na musamman, yaya
shari’a take kallon hakan?

Wa alaikumus salam wa
rahmatullahi wa barakatuhu. Alhamdulillah, game da wannan tambaya, shari’ar
Musulunci ta bayyana cewa bai halatta ga namiji ya sumbanci ɗan’uwansa namiji ba,
musamman idan sumbantar yana zuwa ga baki. Wannan hukunci ya samo asali ne daga
ka’idojin shari’a da ke hana yin duk wani abu wanda zai iya janyo zina ko
lalacewar tarbiyya a cikin al’umma. Haka kuma bai halatta ga mace ta aikata irin
wannan ga ’yar’uwarta mace ba, saboda irin wannan kusanci na iya haifar da
sha’awa mara izini ko miyagun dabi’u kamar luwaɗi
ko madigo.
Malaman fiqihu kamar Imamu Ahmad
ibn Hanbal da Ibnul Muflih sun bayyana a cikin fatawoyinsu cewa haramun ne a yi
sumbanci tsakanin namiji da namiji, ko mace da mace, musamman a wajen da zai
iya haifar da sha’awa ko kusantar jima’i. Duk da haka, idan akwai wani dalili
mai muhimmanci kamar ban-kwana, nuna soyayya ta iyali a yanayin aminci, ko
murnar dawowa daga tafiya, wasu malamai sun bayar da sassaucin hukunci, amma
wannan ba yana nufin yana zama halalla gaba ɗaya
ba.
A cikin shari’ar Musulunci, akwai
ka’ida mai muhimmanci da ake kira Sadduz Zaree’ah, wato “hanawa ko karhanta
wasu abubuwa domin toshe hanyoyin da ɓarna
ke iya shigowa cikin al’umma.” Wannan ka’ida tana nuna cewa duk wani abu wanda
zai iya haifar da lalacewa ko jawo sha’awar haram, kamar sumbanci tsakanin
jinsi ɗaya a yanayi na
kusanci, an hana shi ne domin kare jama’a daga fadawa cikin zunubi.
Har ila yau, addinin Musulunci ya
hana namiji da mace da ba muharraminsu ba su kusanci juna ta hanyoyi masu iya
janyo sha’awa ko lalata. Wannan ya hada da sumbanci akan baki, kumatu, ko wasu
sassan jiki, saboda duk wannan yana iya haifar da lalacewar tarbiyya da kuma
karya ka’idojin tsarkin zuciya da jiki. Wannan hukunci yana goyon bayan ayar
Allah a cikin Alkur’ani, inda Allah Ya ce:
وَلَا تَقْرَبُوا الزِّنَى إِنَّهُ كَانَ فَاحِشَةً
وَسَاءَ سَبِيلًا
“Kada ku
kusanci zina; lallai shi babban abin kunya ne kuma mummunar hanya ce.”
(Al-Isra: 32)
Haka nan, Annabi ﷺ ya yi gargadi akan
duk wani kusanci mara izini wanda zai iya zama matattarar zunubi. Wannan ya
nuna cewa duk wani sumbanci mara dalili tsakanin jinsi ɗaya ko tsakanin namiji da mace da ba muharrama
ba, haramun ne, saboda yana iya jawo sha’awa mara izini da lalacewa ga zuciya
da jiki.
Don haka, hukuncin namiji ya
sumbanci ɗan’uwansa
namiji, musamman akan baki, ko mace ta aikata hakan ga ’yar’uwarta mace,
haramun ne a shari’ar Musulunci, sai dai a yanayi na dalilai na musamman da
babu wani kusanci mai yiwuwa ga sha’awa. Wannan hukunci yana daga cikin
ka’idojin kare mutunci da tarbiyyar al’umma, kuma Allah ne mafi sani.
