Shin Ya Halatta A Jingina Dan Zina Ga Ubansa?

Mutum ne ya yi zina da mace har ta samu ciki, kuma ya ce ya yarda ya karbi cikin idan ta haihu yana son ɗansa, shin a shari'ance ya halatta a jingina wannan ɗan zinar zuwaga ubansa na zinar tunda ya karba ko kuma a'a bai halatta ba?

Malamai sun ƙara wa juna sani dangane da hukuncin jingina ɗan zina zuwaga ubansa, da farko dai dukkan Malamai sun yi Ittifāƙi akan cewa idan Mutum ya yi zina da Matar aure to ana jingina ɗanta ne zuwaga mijinta ba wai wanda ya yi zinar da ita ba, ko da kuwa wanda ya yi zinar da ita ta samu cikin ya yi da'awar cewa cikinsa ne, to ba za a yi aiki da maganarsa ba matukar dai ta haifi yaron a cikin watanni shida ko sama da haka bayan aure, to za a jingina wannan ɗan zuwaga mijinta ne, sai dai idan mijin ne ya kore ɗan ta hanyar Li'āni a kotu ya ce ba ɗansa ba ne.

Sannan idan ya kasance matar ba ta da aure kuma wanda ya yi mata cikin bai yarda cewa na sa ba ne, ko kuma yaƙi yarda ya karbe shi a matsayin ɗansa, to anan ma ƙaulan wahidan Malamai suka ce ba za a jingina wannan ɗan zinar zuwaga wanda ya yi mata cikin ba.

Amma idan wanda ya yi mata cikin ya yarda cewa shi ne yayi, kuma ya yarda ya karɓi cikin a matsayin ɗansa, to anan sai Malamai sukayi Saɓani, mafi yawa daga cikin Malamai cikinsu harda galibin Malaman da ke Mazhabobin nan guda huɗu na Malikiyya, Shafi'iyya, Hanafiyya, da kuma Hanabila. Duk sun tafi ne akan cewa ba za a riskar da ɗan zina zuwaga ubansa na zina ba ko da kuwa uban ya karɓi cikin ya yarda cewa ɗansa ne suka ce ba za a jingina shi zuwa gareshi ba.

Daga cikin dalilansu sun kafa hujja da wannan Hadisin da Annαвi (Sallallahu Alaihi Wasallam) Ya ce:

الولد للفراش وللعاهر الحجر،

MA'ANA: Ɗa na mai shinfiɗa ne (mijinta ko shugabanta idan baiwa ce) shi kuma wanda ya yi zina sai ayi masa Hajaru (idan an samu shaidu kuma ya taɓa aure)

Malaman da suke kan wannan fahimta a wajensu ba za a jingina ɗan zina zuwaga ubansa ba, hakanan babu gado tsakanin Ɗan da Uban sai dai yagaji uwarsa kawai.

To sai dai kuma a gefe ɗaya akwai Malaman da suka tafi akan cewa ana iya jingina ɗan zina zuwaga ubansa matuƙar dai uban ya yi da'awar cewa nasa ne kuma ya karɓa, Malamai da yawa kamar irin su Ibn-Taymiyya, Ibnul-Ƙayyum, Hasanul-Basariy, da wasunsu suna ganin hakan babu laifi musamman idan ya kasance akwai wata maslaha ta rayuwa da aka kalla, shi ya sa ma suka ce ya halatta a ɗaura musu aure bayan ya yi mata cikin.

Daga cikin dalilan Malaman da ke kan wannan ra'ayi sun kafa hujja da cewa asali an halicci wannan yaro ne da ruwan maniyyin wanda ya yi zinar da ita, kuma ya yarda cewa nasa ne, sannan suka ce ai wancan Hadisin da Annαвi (Sallallahu Alaihi Wasallam) Ya ce:

الولد للفراش وللعاهر الحجر،

Yana magana ne akan idan mace tana da miji ne kaɗai, amma idan ba ta da miji to zahirin Hadisin ba ya nuna cewa idan mutum ya yarda cewa ɗansa ne kada a jingina masa shi ba, danhaka suka ce indai har mutum ya yi iƙirarin cewa ɗansa ne to za a jingina shi zuwa gareshi sannan kuma akwai gado a tsakaninsu.

Ba ya ga haka suka ce Malaman da suka tafi akan cewa ɗan zina ba zai gaji ubansa ba dukkansu sun yarda cewa ɗan zai iya gadon mahaifiyarsa, to ta yaya za a ce ɗan zina zai iya gadon uwarsa da ta yi zina ta haife shi amma ba zai gaji ubansa ba alhali uban ya yarda cewa ɗansa ne shi ya yi cikin kuma yana son kayansa? Da wanne dalili suka dogara akan cewa ɗan zina zai iya gadon uwarsa alhali itama uwar ba ta hanyar aure ta haife shi ba.

Wannan dai wata mas'ala ce da aka samu saɓani akanta, sai dai Malamai da yawa a da can da kuma a yanzu sun karkata zuwa ga wannan ra'ayi na ƙarshe cewa ɗan zina zai iya gadon ubansa, musamman idan ya kasance akwai wata masalaha mai karfi da aka yi la'akari da ita akan hakan.

Assalamu alaikum Malam Mutum ne yayi zina da Mace har tasamu ciki, kuma ya ce ya yarda yakarbi cikin idan ta haihu yanason ɗansa, Shin a Shari'ance yana halatta ajingina wannan ɗan zinar zuwaga Ubansa na zinar tunda yakarba kokuma a'a bai halattaba??

Wa'alaikumus Salam warahamtullahi Wabarkatuh

Mālamai sun ƙārawa jūna sani dangane da hukuncin jingina Ɗan-Zina zuwaga ubansa, dafarkodai dukkan Mālamai sunyi Ittifāƙi akan cewa idan Mutum yayi zina da Mātar aure to ana jingina ɗantane zuwaga mijinta bawai wanda yayi zinar da'itaba, koda kuwa wanda yayi zinar da'ita tasamu cikin yayi da'awar cewa cikinsane, to baza'ayi aiki da maganarsaba matukar dai tahaifi yaron acikin watanni shida ko sama dahaka bayan aure, to za'a jingina wannan ɗan zuwaga mijinta, saidai idan mijinne yakore ɗan ta hanyar Li'āni a kotu.

Sannan idan yakasance Mātar bata da aure kuma wanda yayi mata cikin bai yarda cewa nasa bane, kokuma yaƙi yarda yakarbeshi amatsayin ɗansa, to ananma Ƙaulan-Wāhidan Malamai sukace baza'a jingina wannan Ɗan-Zinar zuwaga wanda yayi mata cikinba,

Amma idan wanda yayi mata cikin yayarda cewa shine yayi, kuma ya yarda yakarɓi cikin amatsayin ɗansa, to anan sai Mālamai sukayi Sāɓānī, mafi yawa daga cikin Mālamai cikinsu harda gālibin Malaman dake Mazhabobinnan guda hudu, duk suntafine akan cewa baza'a riskar da Ɗan-Zina zuwaga ubansa ba koda kuwa uban yakarɓi cikin ya yarda cewa Ɗansane, sukace baza'a jinginashi zuwa gareshiba, daga cikin Dalilansu sunkafa Hujja da wannan Hadisin da Annαвi( ) Ya ce

ﺍﻟﻮﻟﺪ ﻟﻠﻔﺮﺍﺵ ﻭﻟﻠﻌﺎﻫﺮ ﺍﻟﺤﺠﺮ ،

MA'ANA

Ɗa namai-Shinfiɗane (mijinta ko shugabanta idan baiwace) shikuma wanda yayi zina sai ayimasa Hajaru (idan ansamu shaidu kuma yataɓa aure)

Malaman dasuke kan wannan fahimta awajensu baza'a jingina Ɗan-Zina zuwaga ubansaba, hakanan babu gādo tsakanin Ɗan da Uban saidai yagāji uwarsa kawai.

To Saidai kuma agefe ɗaya akwai Mālaman da suka tafi akan cewa ana iya jingina Ɗan-Zina zuwaga ubansa matuƙar dai uban yayi da'awar cewa nasane kuma yakarɓa, Malamai da yawa kamar irin su Ibn-Taymiyya, Ibnul-Ƙayyum, Hasanul-Basariy da wasunsu suna ganin hakan babu laifi musamman idan ya kasance akwai wata Maslaha ta rayuwa da aka kalla, shiyasa ma sukace ya halatta adauramusu aure bayan yayi mata cikin, daga cikin Dalilan Malaman dake kan wannan ra'ayi sunkafa Hujja dacewa asali an halicci wannan yarone da ruwan maniyyin wanda yayi zinar da'ita, kuma ya yarda cewa nasane, sannan sukace ai wancan Hadisin da Annαвi( ) Ya ce

ﺍﻟﻮﻟﺪ ﻟﻠﻔﺮﺍﺵ ﻭﻟﻠﻌﺎﻫﺮ ﺍﻟﺤﺠﺮ ،

Yana magane akan idan mace tanada mijine kaɗai, amma idan bata da miji to Zāhirin Hadisin baya nuna cewa idan mutum ya yarda cewa ɗansane kada ajingina masa shiba, danhaka sukace indai har mutum yāyi iƙirārin cewa ɗansane to za'a jinginashi zuwa gareshi sannan kuma akwai gādo atsakaninsu
