Na Dawo A Tafiya Mijina Bai Kwana A Ɗakina Ba

𝐓𝐀𝐌𝐁𝐀𝐘𝐀

As-Salamu Alaikum, Malam, mu biyu ne a wurin mijina. To, sai nayi tafiya a ranar da na fita girki, kuma na dawo ranar da ya kamata in karɓi girki. Amma saboda yanayin tafiya ban shigo gida da wuri har na iya ɗora girkin ba, don haka abokiyar zamana ce tayi mana abinci a wannan daren. Shi kuma da ya zo sai kawai ya shige wurinta ya kwana! Tambayata a nan ita ce: Hakan da ya yi daidai ne?

Wa Alaikumus Salaam Wa Rahmatul Laah.

Da farko wajibi ne a Shari’a kafin miji ya ƙara auren mace ta biyu sai in ya san cewa zai iya yin adalci a tsakaninsu a cikin abubuwan da su ke a fili a bayyane. Allaah (Subhaanahu Wa Taaala) ya ce

ﻓَﺈِﻥۡ ﺧِﻔۡﺘُﻢۡ ﺃَﻟَّﺎ ﺗَﻌۡﺪِﻟُﻮﺍ۟ ﻓَﻮَ ⁠ٰﺣِﺪَﺓً ﺃَﻭۡ ﻣَﺎ ﻣَﻠَﻜَﺖۡ ﺃَﯾۡﻤَـٰﻨُﻜُﻢۡۚ

Idan kuma kuka ji tsoron cewa ba za ku iya yin adalci ba, to sai ku auri guda ɗaya, ko kuma abin da hannuwanku na dama suka mallaka. (Surah An-Nisaa’: 3)

Rabon-kwana yana daga cikin abubuwan da dole miji ya yi adalci a tsakanin matan aurensa a cikinsa. Asali in ji malamai, rabon kwana ɗai-ɗai ne, watau dare ɗaya da yini ɗaya ga kowace mace. Kuma ba zai iya wuce hakan zuwa kwanaki biyu-biyu ko uku-uku ko sama da haka kamar mako-mako ko wata-wata ba, sai da amincewarsu kuma da yardarsu.

Don haka, a lokacin da aka gama kwanakin amarci, watau: Kwanaki bakwai ga budurwa ko kwanaki uku ga bazawara sai mijin ya zaunar da uwargida da amarya domin a tsara rabon-kwanan da sauran duk wasu sharuɗɗa ko yarjejeniyoyin da za a gudana a kansu, don samun ɗorewar zaman lafiya a gidan.

Muhimmin abin da ya kamata a fahimta dai shi ne: Abin da Shari’ar Musulunci ta damu da shi a nan shi ne: Rabon-kwana kawai amma ba girki ko dahuwar abinci ba. Domin ba kowace mace ce take iya yin girki ko dahuwar abinci a koyaushe ba, saboda larurori kamar rashin lafiya ko jego ko komowa daga tafiya ko rashin abin girkawa da sauransu. Wannan kuma ba zai hana a yi rabon-kwana da ita ba. Sannan rabon-kwana a dare ne kuma yini yana bin sa. Don haka, zai iya shiga wurin wacce ba kwananta ba da rana, amma ba da dare ba, sai in da wata larura mai ƙarfi.

Kamar yadda muka ambata a baya, ya halatta a wurin rabon-kwana ma’aurata su kawo duk wata yarjejeniya ko sharaɗin da suke ganin zai taimaka wurin samar da zaman lafiya mai ɗorewa a tsakaninsu, matuƙar dai bai saɓa wa Shari’a ba. Manzon Allaah (Sallal Laahu Alaihi Wa Alihi Wa Sallam) ya ce

« ﺍﻟْﻤُﺴْﻠِﻤُﻮﻥَ ﻋَﻠَﻰ ﺷُﺮُﻭﻃِﻬِﻢْ »

Musulmi suna nan a kan sharuɗɗansu.

A wani lafazi kuma ya ce

« ﺍﻟﺼُّﻠْﺢُ ﺟَﺎﺋِﺰٌ ﺑَﻴْﻦَ ﺍﻟْﻤُﺴْﻠِﻤِﻴﻦَ »

Sulhu halal ne a tsakanin musulmi.

(Abu-Daawud: 3596, kuma Al-Albaaniy ya ce: Hasanun Sahihi ne).

A riwayar Ahmad ya ƙara da cewa

« ﺇِﻻَّ ﺻُﻠْﺤًﺎ ﺃَﺣَﻞَّ ﺣَﺮَﺍﻣًﺎ ﺃَﻭْ ﺣَﺮَّﻡَ ﺣَﻼَﻻً »

Sai dai sulhun da ya halatta haram, ko ya haramta halal

Don haka, kodayake a asali ba girki a ke kallo a wurin rabon-kwana ba, sai dai kuma suna iya yin sharaɗi ko sulhu a kan cewa: Mai girki ita ce da miji, ko kuma ba ita ce da miji ba. Ko kuma duk lokacin da mai tafiya ta dawo ita ce da miji ko ba ita ce da miji ba, da sauransu.

A ƙarƙashin wannan, mijin da ya shiga wurin wacce ta yi abinci a wannan yammacin bai yi laifi ba matuƙar dai haka suka yi yarjejeniya ko sharaɗi tun da farko. Amma idan ba su yi wannan sharaɗin ko yarjejeniyar ba, kuma al’adarsu ba ta gudana a kan hakan ba, to bai yi daidai ba. Domin a fili ya ke cewa: Wacce ta dawo daga tafiya an rage mata kwananta ɗaya, ita kuma waccan an ƙara mata. Don haka, sai a biya ta, watau a rama mata, in dai ba ita ce ta yafe ba.

Duk matar da ta yi tafiya na wasu kwanaki ko watanni, to ba sharaɗi ba ne a ce idan ta dawo sai an rama mata waɗannan kwanakin da ba ta nan, idan kuma aka ce sai an rama mata to an cutar  da sauran matayen ko ɗaya matar idan su biyu ne. Saboda haka kuskure ne babba miji ya rama wa matar da ta yi tafiya kwanakin da ba ta nan, lallai wannan ba dai-dai ba ne, duk matar da ta yi tafiya har zagayowar kwananta ya shuɗe ba ta nan, to haqqin wannan kwana ko kwanaki sun faɗi, ba wata maganar ramuwa, wannan shi ne adalci.
