Assalamu alaikum warahmatullah wabarakatuhu
Malam tambayata ita ce shin idan mutum ya yi azumin farillah ba tare da ya kwana da niyya ba azuminsa ya yi? Kuma shin idan mutum ya yi azumin nafila ba tare da ya kwana da niyya ba kawai ya wayi gari da safe ya ce yana azumi, shin azuminsa ya yi?

Wa'alaikumus Salamu wa Rahmatullah, dangane da hukuncin ɗaukar azumi ba
tare da an kwana da niyya ba, hukuncin ya sha bamban tsakanin azumin Farillah
da azumin nafila a wurin jumhur na malamai, wasu malaman kuma suna ganin duk
hukuncin ɗaya ne:
1. Ibn Umar ya ruwaito hadisi daga Nana Hafsa cewa:
Annabi ﷺ ya ce:
"Wanda duk bai ɗauki niyyar azumi kafin ketowar Alfijir ba, to ba shi da
azumi".
Abu Dáwud (2454), Tirmizhiy (730), Ibn Majah (1700).
Kamar yadda aka faɗa cewa wasu malaman suna da fahimtar cewa wannan hadisin
yana magana ne kawai a kan azumin farillah ban da na nafila, sai ya zama ke nan
duk wanda bai ɗauki niyyar azumin farillah kafin ketowar Alfijir ba, ba
shi da azumi.
2. Nana A'isha ta ruwaito hadisi cewa: Wata rana Annabi ﷺ ya shigo wurinmu
sai ya ce: "Shin akwai wani abu a wurinku?" sai muka ce: babu, sai ya
ce: "To lallai kam ni mai azumi ne", sai ya sake zuwa wurinmu a wata
rana ta dabam sai muka ce masa: Ya Manzon Allah ﷺ an kawo mana
kyautar waina, sai ya ce: "Ku nuna min shi, haƙiƙa na wayi gari ina mai azumi", sai kuma ya ci.

Jumhur na malamai sun fahimci cewa wannan hadisin yana
nuna Annabi ﷺ ya wayi gari ba da ninyar azumin nafila ba ne, amma da
ya tambayi abinci aka ce babu sai ya ɗauki niyyar azumin nafila, sannan kuma ya nuna halascin
mutum ya karya azumin nafila idan ya wayi gari ya sami abinci. Don haka ke nan
wancan hadisi na farko ya keɓanci azumin farillah ne kawai, wannan kuma na biyun ya keɓanci azumin
nafilah.
Sai dai kamar yadda aka faɗi a sama cewa daga
cikin malamai akwai masu fahimtar hadisin akasin haka, su kawai suna ganin
hadisin ya nuna halascin karya azumin nafila ne idan mutum ya sami abinci, amma
ba yana nuna halascin ɗaukar niyyar azumin nafila da rana ba ne. Saboda haka
suke da fahimtar cewa duk azumin da mutum zai yi, na farillah ko na nafilah, to
dole sai mutum ya kwana da niyya saboda wancan hadisi da Ibn Umar ya ruwaito
daga Nana Hafsa ya haɗa duk wani azumi ne, na nafila da na farillah, wato duk
wanda bai kwana da niyya ba, ba shi da azumi.
Saboda mutum ya fita daga saɓanin malamai, duk
azumin da mutum zai yi ko da na nafila ce ya tabbatar ya kwana da niyyar hakan,
idan kuma hakan bai samu ba saboda wata lalura, to ya ɗauki azumin
nafilar ko da kuwa bayan wayewar gari ne matuƙar bai riga
ya karya ba, tun da akwai dalili a kan hakan, kuma azuminsa ya yi da ikon
Allah.
