Assalamu alaikum wa rahmatulLah.
Akramakallahu da fatan kana lafiya.
Ina da wata tambaya ce Mai muhimmanci akan zakkah, Muna da kwamitin masallaci sai mukayi noma don gudanar da aikace-aikacen masallaci. Kuma kayan nan yakai Nisabin, shin akwai zakkah a cikin kayan duk da cewa ba mallakan wani mutum bane?

Wa alaikumus salam wa rahmatulLahi wa barakatuhu.
Babu zakkah a cikin dukiyar kwamitin masallaci. Tun daga kan
kudaden sadaƙah wadanda jama'a suka tattara, har zuwa kan amfanin gonan da
jama'a suka haɗu suka noma domin samun kudaden aiwatar da gyare-gyare a
masallacin.
Domin hakika ita zakkah daga cikin ka'idodinta akwai:
- Wajibi ne ta zamto abin da za a fitar wa zakkar ya kai
nisabi.
- Wajibi ne ya zamto ya shekara guda a hannun mai shi (idan kuɗi
ne).
- Dole ne ya zamto mallakar mutum guda ne, ko kuma wasu mutane
kayyadaddu (idan kuɗi ne ko kampani da ake gudanarwa).
To shi kuma kuɗi ko dukiyar kwamiti ba ya cikin kowanne rukuni
daga waɗanda aka lissafa ɗin nan. Sai dai shi yana cikin rukunin dukiyoyin WAƘAFI
ne. Wato dukiyoyin da jama'a ke bayarwa amatsayin sadaƙah domin Allah, domin
gudanar da ayyukan addini. Shi kuwa wannan ko miliyan nawa ne babu zakkah
cikinsa.
ƘARIN BAYANI
Shin akwai zakkah a cikin
dukiyar kwamitin masallaci ko dukiyar da aka tara domin ayyukan masallaci?
Assalamu alaikum wa
rahmatullahi wa barakatuhu. Akramakallahu, da fatan kana lafiya. Ina da tambaya
mai muhimmanci dangane da zakkah. Muna da kwamitin masallaci, sai muka yi noma
domin samun kudaden gudanar da ayyukan masallaci da gyare-gyare. Amfanin gonar
ya kai nisabi. Shin a irin wannan dukiya akwai zakkah, duk da cewa ba mallakar
mutum guda ba ce, kuma an tanade ta ne domin ayyukan masallaci?
Amsa:
Wa alaikumus salam wa
rahmatullahi wa barakatuhu. A irin wannan hali, mafi yawancin malamai sun
bayyana cewa babu zakkah a cikin dukiyar kwamitin masallaci ko dukiyar da aka
ware domin ayyukan addini kamar gyaran masallaci ko hidimar jama’a. Dalili kuwa
shi ne cewa zakkah tana wajaba ne a kan dukiyar da mutum ya mallaka cikakkiyar
mallaka, wato dukiyar da take hannun mutum ko wasu mutane kayyadaddu kuma suke
da ikon amfani da ita domin kansu. Amma dukiyar kwamitin masallaci galibi tana
shiga cikin abin da ake kira dukiyar waqafi (sadaƙar
da aka keɓe domin ayyukan Allah), wadda ba
mallakar mutum guda ba ce, kuma an tanade ta ne domin amfanin jama’a da addini.
Allah Madaukakin Sarki Ya
bayyana wajibcin zakkah a cikin Alƙur’ani inda Ya ce:
خُذْ
مِنْ أَمْوَالِهِمْ صَدَقَةً تُطَهِّرُهُمْ وَتُزَكِّيهِم بِهَا
“Ka karɓi
zakkah daga dukiyoyinsu domin ka tsarkake su kuma ka tsarkake rayuwarsu da
ita.”
(Suratut Tawbah 9:103)
Malamai sun fahimci daga
irin waɗannan
ayoyi cewa zakkah tana rataye ne da dukiyar mutum ko mutanen da suka mallaki
dukiyar kai tsaye. Haka kuma Allah Ya bayyana rukunin mutanen da ake bai wa
zakkah a cikin wannan aya:
إِنَّمَا
الصَّدَقَاتُ لِلْفُقَرَاءِ وَالْمَسَاكِينِ وَالْعَامِلِينَ عَلَيْهَا
وَالْمُؤَلَّفَةِ قُلُوبُهُمْ وَفِي الرِّقَابِ وَالْغَارِمِينَ وَفِي سَبِيلِ
اللَّهِ وَابْنِ السَّبِيلِ فَرِيضَةً مِّنَ اللَّهِ
“Hakika zakkah ana bayar da
ita ne ga matalauta, da miskinai, da ma’aikatan tattara ta, da waɗanda
ake son jawo zukatansu, da ’yanta bayi, da masu bashi, da a tafarkin Allah, da
matafiyi; wannan farilla ce daga Allah.”
(Suratut Tawbah 9:60)
Saboda haka, idan dukiyar da
aka tara ta kasance an keɓe ta ne domin ayyukan
masallaci kamar gyara, gudanar da lamuran addini, ko ayyukan jama’a, to tana
kama da dukiyar waqafi. Wannan nau’in dukiya ba ta shiga cikin dukiyar da ake
fitar wa zakkah, domin ba mallakar mutum ba ce, kuma an ware ta ne domin aikin
alheri. Wannan fahimta ce da malamai da dama suka bayyana a cikin fikihu, ciki
har da manyan malamai irin su Ibn Qudamah wanda ya yi bayani a cikin
littattafan fikihu cewa zakkah tana wajaba ne a kan dukiyar da mutum ya mallaka
cikakkiyar mallaka, ba a kan dukiyar da aka ware domin waqafi ba.
Sai dai ya kamata a lura
cewa idan mutum ya mallaki wani abu na kansa daga cikin wannan aikin noma ko
wani bangare na dukiyar, wanda yake a matsayin rabonsa na kansa kuma ya kai
nisabi ya kuma cika sharuddan zakkah, to a nan ne zakkah za ta wajaba a kansa.
Amma idan duk dukiyar an ware ta ne gaba ɗaya
domin masallaci da hidimar addini, to ba za a fitar da zakkah daga cikinta ba
ko da kuwa ta kai kudi masu yawa.
Allah ne mafi sani.
ﺳُﺒﺤَﺎﻧَﻚَ ﺍﻟﻠَّﻬُﻢَّ ﻭَﺑِﺤَﻤْﺪِﻙَ ﺃﺷْﻬَﺪُ ﺃﻥ ﻟَﺎ ﺇِﻟَﻪَ ﺇِﻻَّ ﺃﻧْﺖَ ﺃﺳْﺘَﻐْﻔِﺮُﻙَ ﻭﺃَﺗُﻮﺏُ ﺇِﻟَﻴْﻚ
