Hukuncin Kyautar Da'ake Baiwa Ma'akata

Mene ne matsayin kyautar da mahaifin dalibina zaiban idan yazo dubashi da kuɗin da police da sojoji ke karɓa ahanya?

الحمد لله.

Yazo acikin hadisin Abu humaid Assa'idi Allah yakara yarda da shi ya ce: Annabi Sallallahu Alaihi wasallam yawakilta wani mutum ana cemasa ibnu lutbiyyah akan zakkah, Lokacin dayazo wajan manzan Allah Sallallahu Alaihi wasallam sai ya ce: Wannan nakune, wannan kuma kyautarsa aka bani, Sai Annabi ya ce: ( Shin Yazauna agidan Ubansa ko babarsa mana yagani mutane zasu bashi kyauta kozasu hanashi, Narantse dawanda ran muhammad ke hannunsa, Babu wanda zai karɓi irin wannan kyauta face ranar alkiyama yazo da abunda ya karɓa yana dauke da shi awuyansa, in rakumine yana kuka, ko saniya tana kuka, ko akuyace tana kuka, sai yadaga hannunsa sama harsaida muka hango farin hammatarsa Yana cewa Ya Allah na isar ya Allah na Isar ya Allah na isar sau uku) Bukhari (1429) da Muslim ( 1832).

Ibnu hajar rahimahullah ya ce: Annabi Sallallahu Alaihi wasallam ya bayyana masa hakkokin dayake aiki adalilinsu yasa aka bashi kyauta, da zai zauna agidansa baza'a bashi kyautar ba, bai kamata ya halattawa kansa itaba saboda ta iso wajansa ta hanyar kyauta.

Sabo haka sai ka ban-bance tsakanin kyautar data halatta dawacce ta haramta.

Duk kyautar da anbaka itane saboda kana wani aiki da kula da wani office wanda tadalilin hakan yasa aka baka kyautar to wannan kyautar haramunce. daza ka bar wannan matsayin koka dena aikin baza'abaka wannan kyautar ba.

Wajibine ka mayar wa da mutum abarsa kokaƙi Amsa tun farko.

Wannan irin karramawa da kyauta tanasa ma'aikaci yadunga kare mai masa kyautar daka wani abu wanda baya bisa ƙa'ida ko yi masa abunda baya bisa doka, harma yabashi abunda ba hakkinsa ba ne, koya yadunga sakaci da abunda yake zai amfani jama'a, duk wannan illar tana komawa kan ma'aikacinne.

Imamun Nawawi rahimahullah wajan sharhin wannan hadisin ya ce: acikin hadisin akwai bayanin kyautar da'ake baiwa ma'aikata haramunce kuma gululice, domin yai ha'inci cikin aikinda aka daukeshi yayi, da amanar da'aka ɗora masa, Annabi sallallahu Alaihi wasallam yabayyana acikin hadisin dalilin da yasa aka haramta kyautar da'ake baiwa ma'aikaci, ana bada itane saboda damar datake hannun mutum ta aikin dayakeyiwa jama'a, saɓanin kyautar da'ake baiwa wanda ba ma'aikaci ba, ita abar soce ayita, Sharhin Muslim ( 12/219).

Shaik Usaimeen rahimahullah ya ce: Kyautar da'ake baiwa ma'akata tana cikin gulili satar dukiyar talakawa, idan mutum yana kan wani aikin gwamnati, sai wani yabashi kyauta wacce tanada alaƙa da office ɗinsa kowannan aikinda yakewa gwamnati to wannan kyautar tana cikin gululi satar dukiyar talakawa, bai halatta ya karɓi komai daka cikinta ba, koda bisa san ran wanda yabada itane.

Abunda yake wajibi akan wani jami'in tsaro ko ma'akaicin gwamnti shi ne kada ya karɓi duk wata kyauta daza'a bashi wacce take da alaƙa da aikinda yake, insun karɓa su mayarwa  wanda yabasu, anbaiwa mutum dasunan kyauta koda sunan sadaƙa, koda sunan zakkah, musamman idan ma'aikacin mawadacine, zakkah bata halatta agareshiba kamar yanda yake abune sananne.

saboda haka kyautar da mahaifin yaro zai baka inyazo dubashi amakaranta kai malaminsa cin hancice haramun ne kakarɓa, domin inda baka wannan malantar kasuwa kake bawanda zai baka kyautar, haka kuɗin da sojiji suke karɓa kan hanya ko 'yan sanda ko jami'an gwamnti duka haramun ne koda dasan ran mai badawar ba tilasce tasa ya bayar ba.

domin hakan yakansa kaki yin aikinka tsakani da Allah yanda ka'idar aikinka ta tanadar akan wanda yake baka kyautar sai shari'a ta haramta saboda wannan illar, domin in jami'in tsarone hakan na iyasa kakyale mai laifi yawuce da abunda zai cutar da al'umma wanda wannan cin amanar aikin da aka ɗora makane, inkai malamine kana karɓar kyauta daka iyayen yara hakan zaisa kake basu sakamakon jarrabawar wanda kokarinsu baikai ba.

haka duk wani aiki dakake karkashin hukuma indai kana karɓar kyautar da dalilin wannan aikin dakene yasa aka baka ita tabbas za ta saka ka kasa adalci akan Wanda yabaka ita kamar yanda Annabi sallallahu Alaihi wasallam ya bayannawa wancan mutum acikin hadisi.

dan haka sai muyi hattara, kuma duk yawan abunda kake karɓa hannun mutane saboda ofis ɗinka ko damar daka samu cikin gwamnati za kazo da shi ranar alkiyama awuyanka.

Amma kai maibayarwa idan ka ce baza ka dada wannan cin hanciba za'a zalunceka ko hakkinka zai makale yaƙi fita yahalatta kacira kabayar kai Allah ya'isa amma shikam yatabbatar yaci rashawa yaci haramun ranar alkiyama zaizo da abunda ya karɓa.

Allah maɗaukakin sarki muke roko daya azurtamu da halal mai daɗi, ya tseratar damu aukawa cikin haramun.
