Shin Malam Khamis ya halatta mutum ya ci bashi dan yin layya?

Wa alaikumussalam wa rahmatullahi wa barakatuh.
Barka da
wannan tambaya mai muhimmanci. Tambayar cin bashi domin yin layya tana da alaƙa kai tsaye da
matsayin layya a shari’a. Don haka, dole ne mu fara fahimtar matsayin layya, sannan mu
duba hukuncin cin bashi a kanta.
1. Matsayin Layya a Tsakanin Malamai
Kafin mu
tattauna batun cin bashi, ya kamata mu fahimci cewa malaman Musulunci sun
bambanta kan matsayin layya:
- Wajibi
(Farz/Wajib): Wannan
shine ra’ayin mazhabar Hanafiyya, kuma shi ne ra’ayin da aka jingina wa
Sheikhul Islam Ibn Taimiyyah da Sheikh Ibn Uthaymin (Allah ya jiƙe su). Suna ɗauka
cewa layya wajibi ce ga mai wadata, kuma barinta zunubi ne .
- Sunnah
Mu’akkadah (Sunnah mai Ƙarfi): Wannan shine ra’ayin mazhabar
Malikiyya, Shafi’iyya, da kuma mafi yawan malaman Hanbaliyya. A nan, layya
ba wajibi ba ce, amma ana ƙarfafa
ta sosai .
Magana mafi ƙarfi: Shehu
Ibn Baaz (Allah ya jiƙe shi) ya ce: “Babu wani abu a cikin hujjojin shari’a da ke nuna
cewa layya wajibi ce. Ra’ayin cewa wajibi ce ra’ayi ne mai
rauni” [citation:0].
2. Hukuncin Cin Bashi Domin Yin Layya
Bisa ga mafi
yawan malaman Musulunci, ba a halatta cin bashi domin yin layya ba,
musamman idan mai bashi ba shi da tabbas zai iya biya. Dalili shi ne:
layya ba wajibi ba ce, don haka bai kamata mutum ya ɗora wa kansa nauyin bashi don
wani aiki da ba a wajabta masa ba .
Annabi (ﷺ) ya yi kashedi game
da bashi. A cikin Hadisi:
Arabic:
نَفْسُ الْمُؤْمِنِ
مُعَلَّقَةٌ بِدَيْنِهِ حَتَّى يُقْضَى عَنْهُ
Hausa
fassarar:
“Ran mumini tana ɗaure da
bashinsa har sai an biya shi.”
(Sunan Tirmidhi, Hadith No. 1078; kuma an inganta shi a Sahih Sunan Tirmidhi)
Idan bashi
yana da wannan matsayi, to ba za a shiga cikinsa ba don abin da ba wajibi
ba .
3. Lokutan Da Cin Bashi Ya Halatta
Akwai wasu
yanayi na musamman da cin bashi domin yin layya zai halatta:
Na Farko: Idan
mutum yana da tabbacin zai iya biya bashin, kamar ma’aikaci da zai karɓi albashinsa a ƙarshen wata. A
nan, cin bashi yana da kyau, domin bashi ne na ɗan lokaci kuma ba zai sa shi cikin wahala ba [citation:0].
Sheikhul Islam
Ibn Taimiyyah (Allah ya jiƙe shi) an tambaye shi game da mutumin da ba shi da ikon yin
layya, shin zai ci bashi? Ya ce:
Arabic:
إِنْ كَانَ يَقْدِرُ عَلَى
الْوَفَاءِ وَاسْتَقْرَضَ لِيُضَحِّيَ فَذَلِكَ حَسَنٌ، وَلَكِنْ لَا يَجِبُ
عَلَيْهِ ذَلِكَ
Hausa
fassarar:
“Idan yana iya biya, kuma ya ci bashi domin ya yi layya, to wannan abu ne mai
kyau, amma ba a wajabta masa hakan ba.”
(Majmu’ Fataawa, 26/305)
Na Biyu: Idan
bashin ba zai sa mutum ya yi sakaci ga iyalinsa ba, kuma yana da ikon biya.
Amma idan yin layya zai sa ya yi watsi da biyan buƙatun iyalinsa
(nafaka), to bai kamata ya ci bashi ba, domin ciyar da iyali wajibi ne, kuma
wajibi yana gaban sunna .
Annabi (ﷺ) ya ce:
Arabic:
كَفَى بِالْمَرْءِ إِثْمًا
أَنْ يُضَيِّعَ مَنْ يَعُولُ
Hausa
fassarar:
“Ya isa mutum ya zama mai zunubi idan ya ɓatar da wanda yake kula da shi.”
(Sunan Abi Dawud, Hadith No. 1692; Sahih Muslim, Hadith No. 996)
4. Lokutan Da Cin Bashi Ba Ya Halatta
Na Farko: Idan
mutum ba shi da tabbacin biya, ko kuma ya riga yana cikin nauyin bashi. A nan,
bai kamata ya ƙara wa kansa bashi ba don abin da ba wajibi ba .
Idan mutum
yana da bashi wanda yake biya, sai ya biya bashin nasa na farko, domin bashin
wajibi ne. Layya ba za ta zama wajibi ba har sai an share bashi .
Na Biyu: Idan
bashin da zai ci yana da riba (riba), to haramun ne a Musulunci. Ba a halatta
mutum ya shiga bashin riba domin yin layya, ko da yana da ikon biya .
Allah ya ce:
Arabic:
وَأَحَلَّ اللَّهُ الْبَيْعَ
وَحَرَّمَ الرِّبَا
Hausa
fassarar:
“Kuma Allah Ya halatta ciniki, kuma Ya haramta riba.”
(Al-Baqarah 2:275)
Na Uku: Idan cin
bashin zai sa mutum cikin wahala mai tsanani, ko zai hana shi cika buƙatun yau da
kullum na iyalinsa. A nan, bai kamata ya ci bashi ba. Allah baya so ya dora wa
bayinsa wahala da ba za su iya ba .
5. Taƙaitaccen Hukunci
A taƙaice, ga
matakan hukunci game da cin bashi domin yin layya:
- Asali: Ba a halatta cin
bashi domin yin layya, saboda layya ba wajibi ba ce ga mafi yawan malamai,
kuma bashi yana da nauyi.
- Ya
halatta idan
mutum yana da tabbacin biya (kamar ma’aikaci da zai karɓi
albashi), kuma bashin ba zai sa ya yi sakaci ga iyalinsa
ba.
- Ba
ya halatta idan
mutum ba shi da tabbacin biya, ko yana cikin nauyin bashi, ko kuma bashin
yana da riba (interest).
- Mafi
kyau shi
ne mutum ya yi layya da kuɗin da yake da shi a
hannu, ba da bashi ba. Kuma idan bai samu ba, to barin layya ba laifi.
Allah ne mafi
sani.
