Malam mene ne hukuncin auren kashe-wuta a shari'ance??

Wato dai Abin da ake ƙira da suna Auren-Kashe-Wuta shi ne, Mutum yasaki Matarsa har Saki (3), kuma daga baya sai ya ji yanason yadawo da'ita to kuma babu damar yin hakan a Shari'ance, to shi ne sai Mijin su haɗa baki da wani abokinsa akan cewa abokin ya aureta daga baya kuma yasake sai takoma gidan tsohon Mijinta, wato dai anufinsu shi ne kamar sun yiwa Shari'ar Aℓℓαн () wayo kenan, Ko-Shakka-Babu cewa auren Kashe-Wuta haramunne bai halattaba, kamar yadda ya zo a cikin Hadisi Mαɳɳ Aʅʅαԋ (Sallallahu Alaihi Wasallam) Yana cewa:

" ﻟﻌﻦ ﺍﻟﻠﻪ ﺍﻟﻤﺤﻠﻞ ﻭﺍﻟﻤﺤﻠﻞ ﻟﻪ " (ﺭﻭﺍﻩ ﺃﺑﻮ ﺩﺍﻭﺩ)

MA'ANA: Aℓℓαн () Ya tsirewa Mai Halattawa (mai Auren Kashe-Wuta) da kuma wanda za a Halattawa (tsohon mijin kenan).

Danhaka kenan idan Mutum yasaki Matarsa har Saki (3) to bai Halatta yadawo da'itaba dole sai ta auri wani Mijin kuma ingantaccen aure, kuma bawai ya aureta ba ne da nufin nangaba yasake ta dan takoma wajen tsohon Mijintaba, Sannan kuma Sharaɗine ya kasance Mijinda ta aura ɗin yataɓa Jima'i da'ita aƙalla ko da sau ɗayane, to idan Mijin ya rasu ko kuma yasake ta dan raɗin kansa, to ya halatta takoma wajen tsohon Mijhnta ya aureta, amma idan yazamana cewa Sabon Mijin da ta aura baitaɓayin Jima'i da'itaba har suka rabu da shi, to haryanzu batazama halal ga tsohon Mijintaba dole sai tasake wani auren kenan.

Amma idan ya kasance Mijin dayasaki Matar saki uku, dama sunhaɗa bakine da shi da wani abokinsa da kuma ita Matar akancewa shi abokinnasa ya Aureta inyaso daga baya sai yasake ta ta dawo wajen tsohon Mijinta, to ko shakka babu cewa wannan haramunne kuma Kaba'irace daga manyan zunubai, Sannan kuma shi wanda ya aureta ɗin danufin haka aurensu da'itaɗin Ɓataccene a Shari'a, idanma yasadu da'ita to Zina kawai sukayi, hakanan kuma ko da ya sake ta to bai halattaba takoma wajen Mijinta nafarkonba, idankuma har takoma yasake aurenta to sutabbata cewa zaman Daduro (zina) sukeyi.

Amma idan shi wanda ya aureta ɗin babu wani haɗin baki dasukayi da tsohon Mijinnata wataƙilama shi tsohon Mijinnata baisanma cewa wannan ɗin zai auretaba, amma shi kuma wanda zai aureta ɗin dama azuciyarsa yanaso kawai ya aureta dan yasake ta taƙara komawa wajen tsohon Mijinta, to shi ma aurensa da Matar Ɓataccen aurene sakamakon mummunar niyyarsa kuma shi ma in yasadu da'ita to zina kawai sukayi, danhaka shi ma ko da yasake ta to baihalatta takoma wajen Mijinta nafarkoba.

Amma idan ya kasance ita Matar dama azuciyarta tanasone ta auri wani danufin cewa idan suntare daga baya zatanemi yasake ta ko kuma ta yi ta munana masa haryagaji yasake ta, to anan sai Malamai sukayi Saɓani, Mazhabin HANABILA da kuma wasu daga cikin Malamai kamar irin su: Hasanul-Basriy, Ibrahimun-Nakh'iy, Shaikhul-Islam Ibn-Taimiyya, Suka ce shi ma wannan nau'ine na auren Kashe-Wuta, danhaka shi ma bai halattaba sakamakon mummunar niyyarta, Sannan suka ce idan ɗaya daga cikin su ukun (wato mijin ko matar ko kuma shi wanda zai aura) ya yi nufin a yi auren kuma daga baya asake ta takoma wajen nafarko, suka ce duk hukuncinsu ɗayane auren baiyiba.

Sai dai Mazhabin MALIKIYYA da kuma wani sashe na HANABILA suka ce idan har yasake ta to ya halatta takoma wajen tsohon Mijinta suka ce niyyarta na auren Kashe-Wuta ba ta da wani tasirin da za ta ɓata aurensu, Sai dai wasu daga cikin Ma'abota Ilimi suka ce Maganar farko tafi ƙarfi, tun da asali bai halatta takomaba harsai ta yi ingantaccen aure, amma yanzu taje tayine da nufin nangaba takashe auren awani lokaci sananne suka ce bai halattaba, domin yazama kamar ta yi auren Mut'ane kenan, Sannan kuma gashi ta yaudari Mijin, ta cutar da shi, ta munana masa, dankawai yasake ta.

Sai dai Mafi yawa daga cikin Malamai suka ce idan harMijinta nabiyun yasake ta to yahalatta takoma wajen Mijinta nafarko, suka ce duk wanda igiyar aure ba ahannunsa takeba to niyyarsa ta rabuwa ba ta da wani tasiri, domin ba ta da'ikon ta'iya sakin kanta dakanta dole sai ansake ta, Sai dai abin da tayiwa Mijin na yaudara da munanawa suka ce ananne takeda laifi, da kamata ya yi a ce ta yi amfani da hanya maikyau wacce Mijin bazai cutu sosaiba, wato ta lallabashi har ya yarda su yi Khul'i ta mayar masa da Sadaƙinsa, hakan shiyafi dacewa.

HUKUNCIN AUREN KASHE-WUTA

Mene ne hukuncin auren wanda yasaki matarsa saki uku, sannan ya sa wani ya aure ta yasaketa domin yasake aurenta tadawo gidansa?

الحمد لله والصلاة والسلام على أشراف الخلق الله.

Idan mutum yasaki matarsa saki uku, ba za ta sake zama halal agareshi ba harsai wani ya aure ta, Aure na kwadayi bawai Auren kashe wutaba, Sannan suka rabu da ita, saboda fadin Allah madaukakin Sarki a cikin Suratul Baƙara ayata (230):

فَإِنْ طَلَّقَهَا فَلَا تَحِلُّ لَهُ مِنْ بَعْدُ حَتَّىٰ تَنْكِحَ زَوْجًا غَيْرَهُ ۗ فَإِنْ طَلَّقَهَا فَلَا جُنَاحَ عَلَيْهِمَا أَنْ يَتَرَاجَعَا إِنْ ظَنَّا أَنْ يُقِيمَا حُدُودَ اللَّهِ ۗ وَتِلْكَ حُدُودُ اللَّهِ يُبَيِّنُهَا لِقَوْمٍ يَعْلَمُونَ

Sa´anan idan ya sake ta (na uku), to, bã ta halatta a gare shi, daga bãya, sai tã yi jima´i da wani miji waninsa. Sa´anan idan (sãbon mijin, watau na biyu) ya sake ta, to, bãbu laifi a kansu ga su kõma wa (auren) jũna, idan sun (mijin farko da matar) yi zaton cewa zã su tsayar da iyãkõkin Allah, kuma waɗancan dõkõkin Allah ne Yana bayyana su ga mutãne waɗanda suke sani.

Abu dauda yaruwaito hadisi (2076) Annabi Sallallahu Aaihi wasallam ( ya tsinewa mai Auren kashe wuta, dawanda ya aura danta halatta gawanda yasaketa).

Haramunne da mijin farko suka hada baki banda sanin daya mijin, ko matar da mijinne suka hada baki banda sanin ita matar, Malamai Sunyi Saɓani Amma ingantacciyar magana shi ne kota wacce hanya akayishi haramunne.

Shaikul Islam Ibnu taimiyyah ya ce: " Hasan da Naka'iy suka ce: idan daya daka cikin ukun yabada himma to Auren kashe wutane, mijin farko dana biyun da ita matar, An ruwaito haka daka Ibnul Musayyeeb, lafazin Ibrahimun naka'iy: idan niyyar daya daka cikin Su ukun ( Mijin farko, kona Biyu, ko matar) Auren kashe wutane, wannan nakarshen bataccene ba za ta halatta ga mijin farkon ba....

Saboda haka wannan Aurene batacce kuma bata halatta ga mijinta nafarko ba, kuma kaba'irane cikin manyan zunubai.

Zata halatta agareshi ne kaɗai idan miji nabiyu abisa radin kansa yanemi Aurenta, harsai yadan-dani dadinta ta dan-dani dadinsa sunzauna sosai, randa Allah yakawo musu rabuwa suka rabu, idan mijin farko yaga haryau yanada Bukata a kanta saiya aure ta tadawo wajansa.
