Shin Yahalatta Haɗa Kalar Abunci Guda Biyu A Bayar Da Zakkar Fidda-Kai?

Malamai sun yi saɓani a kan halaccin hada nau'in abunci guda
biyu ko sama dahaka a bayar da zakkar fidda-kai dashi, abisa zantuka guda biyu.
1. Magana tafarko: Bai halatta ba kuma ba ta yi ba, shafi'iyyah da ibnu hazam
azzahiry, sun dogarane dazahirin nassoshin da sukazo cewa ana bayar da zakkar
fidda-Kai sa,i ɗaya ne a cikin
nau'ikan abunci sanannu, saboda haka idan mutum yafitar da rabin sa'i daka
nau'in abunci darabin sa'i daka wani Nau'in babu wani nassi ɗaya kawo misalin
hakan.
Annawawi a cikin
Almajmu'u (6/98-99) ya ce: " Shafi'i ya ce: bai halatta bayar da sa'i ɗaya na nau'in
abunci kala biyu ba azakkar fidda-kai, kamar yanda akaffarar rantsuwa bai
halatta yaciyar da mutum biyar ba ya tufatar da mutum biyar ba, domin an umarce
shi ne ya bayar da sa'i na dabino ko acca, dasauransu, kuma bai fitar da sa'in
daka daya daka cikinsu ba, kamar yanda aka umarceshi yaciyar da miskinai guda
goma ko tufatar dasu, bai ciyar da mutum goma asiffar da'aka ambata ba kuma bai
tufatar da su ba.
Tuhfatul Muhtaaj (3/323).
Ibnu hazam a
cikin Almuhallah(4/259) ya ce: " bai halatta yafitar da wani sashi na sa'i
alkama wani sashin kuma dabino, haka bai halatta kimantata dawani abunba
a'asali, domin wannan bashi ne abunda Annabi sallallahu Alaihi wasallam ya
wajabta ba.
2. Zance na Biyu: Ta inganta kuma ta yi, shi ne maganar
Hanafiyyah da hanabila, su suntafi zuwa ma'ana ba zahiri ba, domin sa'i ɗaya na nau'ikan
abunci hade da juna zai tabbatar da dauke bukatar talaka, da tsarkake rai, da
fitar da sadaka.
Ibnu rajab Alhambali a cikin ƙawa'idul fiƙhiyyah ƙa'ida ta (101, shafi na 229) ya ce: "Wanda aka baiwa zabi tsakanin abubuwa guda biyu, kuma zai
iya kawo rabin kowanne shin hakan ya isar masa ko a'a?
Akwai saɓani wanda wasu mas'alolin zasu bijiro karkashi daka
cikinsu akwai.
@ - Da mutum zai yi kaffarar rantsuwa tahanyar ciyar da
mutum biyar ya tufatar da biyar, hakan ya isar masa abisa zance mafi shahara.
@- Da mutum zai fitar da sa'i daya na jinsin abunci guda
biyu azakkar fidda-kai, mazhaba shi ne ta yi, dakuma rashin ingantuwar zakkar.

Amma mazhabar datafi karfin hujjah afahimtar mu a kan wannan mas'ala ita ce mazhabar
shafi'iyyah da kuma ta ibnu hazam Allah yajikansu.
Domin shi ne zahirin abunda sunnar Annabi sallallahu
Alaihi wasallam yanuna, Sa'i daya na alkama ko accah ko dabino dasauran dangin
kayan abunci.
Kuma haka sabbbai suka kasance suna fitar da ita, duk
wanda yafitar da ita sa'i na kalar abunci biyu bai fitar da ita yanda Annabi
sallallahu Alaihi wasallam yai umarni ba.
