AMSA:

Haramun ne mutum namiji ya taba wadda ba muharramarsa ba

An karbo daga Urwah, Nana Aisha RA ta ce masa: Lokacinda matan Muhajirun sukai hijira zuwa Madina sun kasance suna Mubaya'a ne ba da musaffah ba (Gaisuwar hannu da hannu), ta ce: Annabi SAW bai taba shafa hannun wata mace da hannunsa ba. Hadisin da al-Tabaraani ya rawaito a cikin al-Kabeer da kuma al-Awsat da aka rawaito cewar Annabi SAW yana gaisawa da mata da karkashin hannun riga, wannan hadisi da'ef ne (Al-Haytham ya ce bai ingantaba saboda a cikin isnadin hadisin da akwai 'Ataab ibn Harb shikuma a ilimin hadisi da'eef ne)

Gaba daya mazhabobin Hanafiyya, Malikiyya da Hanbaliyya duk sun tafi akan hukuncin taba mace ko yin musafaha da ita haramunne

Mazhabain Shafi'iyya kuma Imam an-Nawawi ya ce: "Haramunne taba mace ta kowacce siga". Shi kuma Wali al-Deen al-'Iraaƙi ya kara da cewar saidai idan ya zamana idan har Annabi SAW wanda yake gudun fadawa zargi zai yi taka tsantsan to sauran mutane su ya fi cancanta su nesanta da hakan

Manyan malamai sun karawa juna sani akan cewar haramun ne taba jikin wadda ba muharrama ba ko da kuwa fuskarta ce. Amman sun samu banbancin ra'ayi ta bangaren kallon mace idan babu sha'awa kuma hakan bazai haifar da wata fitina. Idan ya zamana akwai ad-darurat (larura) misali: rashin lafiya, cire haƙori. Idan babu macen da za ta iya wannan aikin to ba matsala idan mutum ya taba wadda ba muharramarsa ba (misali: ya ji jikinta akwai zafi ko wani abu makamancin haka)

Don haka a takaicedai indai har babu wani abu da ya fita daga jikinsa silar sha'awa to alwalarsa tananan in sha Allahu saboda a bisa babin larurane ya taba wadda ba muharramar ta sa ba

Hadisin "Innamal a'amali binniyati" shi ne zai aiki anan

Idan ya yi ne a bisa ad-darurat (larura) to ba matsala amman idan da niyyar jin sha'awa ya yi to haramun ne

Question and Answers in Islam

🕌 1. Asalin Hukuncin Taba Mace

A cikin shari’a, haramun ne namiji ya taba mace da ba muharramarsa ba (wato wadda ba halalinsa ba), saboda fadin Annabi :

"Lain yu’ana fī ra’si ahadikum bi makhīin min adīd khayrun lahu min an yamassa imra’atan lā taillu lahu."

(A Tirmizi, Al-abarāni, da Al-Albāni ya inganta – Sahih Al-Jāmi’, 5045)

Ma’ana: “A soka wa mutum ƙarfen ƙusa a kansa ya fi alheri gare shi fiye da ya taɓa mace da ba halalinsa ba.”

Annabi ma bai taba hannun wata mace ba a lokacin da yake karɓar mubaya’a (rantsuwa) daga mata. Nana Aisha (RA) ta ce:

"Wallahi, hannun Manzon Allah bai taba hannun wata mace ba. Sai dai da magana kawai yake karɓar mubaya’a."

(Sahih Muslim, 1866)

🧕 2. Hukuncin Taba Saboda Larura (Darura)

Idan larura ce kamar:

likita yana duba mara lafiya mace,

ko yana yi mata allura,

ko yana duba zafin jiki (temperature),

to wannan ya halatta idan:

1. Babu mace likita a wancan lokacin,

2. Kuma babu sha’awa ko jin daɗi a zuciya,

3. Kuma ya tsaya kan iyakar abin da ake bukata, ba ya ƙetarewa.

Wannan yana ƙarƙashin ƙa’idar shari’a:

الضَّرُورَاتُ تُبِيحُ الْمَحْظُورَاتِ

Lalura tana halatta abin da aka hana.”

Sai dai kuma ka’idar ta cigaba da cewa:

وَتُقَدَّرُ بِقَدَرِهَا

Amma sai a tsaya gwargwadon abin da ake buƙata kawai.”

Wato: idan likita zai iya yin abin ba tare da taɓa fata kai tsaye ba (misali, ta hanyar safar hannu ko zani), to ya wajaba ya kiyaye hakan.

💧 3. Matsayin Alwala

Idan likita ya taɓa mace saboda aikin likita, ba da niyyar sha’awa ba, to:

Alwalarsa ba ta lalace ba,

Domin wannan taɓawa ta cikin darura ce, ba ta jima’i ko jin daɗi ba,

Kuma niyya (niyyah) ce ke bambanta al’amura, kamar yadda hadisin Annabi ya tabbatar da cewa:

"Innamal a‘mālu bin-niyyāt..."

(A Bukhari da Muslim)

Ayyuka suna bin niyya.”

Amma idan ya taɓa da sha’awa ko niyyar jin daɗi, to wannan haramun ne, kuma idan ya fita wani abu daga jikinsa saboda sha’awa, alwalarsa ta lalace.

📚 4. Matsayin Mazhabai

Hanafiyya, Malikiyya, da Hanbaliyya: duk sun yarda cewa haramun ne taɓa mace da ba muharrama ba.

Shafi’iyya: sun ƙara cewa duk wani taɓawa, ko da ba da sha’awa ba, ya sabawa alwala.

Amma duk mazhabobin sun yarda cewa larura ta magani tana ba da izini cikin ƙa’ida.

🌿 Kammalawa:

1. Haramun ne a taɓa mace da ba halalinka ba — sai saboda darura.

2. Likita ko mai taimako idan ya taɓa mace saboda aikin lafiya, kuma babu sha’awa, to babu laifi.

3. Amma dole ya tsaya kan abin da ake buƙata, ya kuma nisanci kallon ko taɓa al’aura.

4. Alwalarsa tana nan matuƙar ba taɓawar sha’awa ce ba.

اللهم طهر قلوبنا وأبصارنا من الفتن، واحفظنا بما تحفظ به عبادك الصالحين.

Ya Allah Ka tsarkake zukatanmu da idanunmu daga fitina, Ka kare mu kamar yadda Ka kare bayinka salihai.”
