HUKUNCIN AUREN MATAR DA AKA ƊAUKI TSAWON LOKACI BA A SAN INDA MIJINTA YAKE BA

Dangane da wannan Mas'ala ta hukuncin auren Matar da akaɗauki tsawon lokaci ba'asan inda Mijinta yakeba, wataƙila harma anhaƙura anfidda rai dashi har ta auri wani Mijin, to kuma kwatsam bayan ta yi aure saiga tsohon Mijinta ya dawo, to wai yanzu Matar ta waye a cikin su biyun? Alal-Haƙiƙa Malamai Ahlul-Ilmi sun yi maganganu daban-dabam akan wannan Mas'ala:

1. Ƙauli nafarko shi ne, mafi yawan Malaman dake Mazhabobin SHAFI'IYYA, HANAFIYYA, HANABILA, suntafine akan cewa shi wannan tsohon Mijinnata na farko da ya dawo shi ne Mijinta domin Asali dama Matarsace, danhaka auren da'aka ɗaura mata da wancan Mijin nabiyu, to ayanzu sunansa Ɓataccen Aure domin ba a buƙatar wai sai yace yasaketa, amma idan Mijin nabiyu yasadu da'ita to shikenan taci Sadaƙinta, idankuma sunhaifi 'Ya'ya tare dashi to za a jingina masa 'Ya'yansane zuwa gareshi amatsayin 'Ya'ya na Halal, za suci gadonsa shima zai'iyacin gadonsu, saboda kasancewar (Shubuha) r da ta faru atsakani, Saidai kawai yanzu ita Matar zata zaunane ta yi iddar wancan Mijin nabiyu, daga nan sai suci gaba da zama tare da asalin Mijinta ba tare da ansake wani ɗaurin aureba, Saidai Mazhabin HANAFIYYA sunkafawa Matar Sharaɗin cewa baza ta yi aureba har sai intasamu labarin tabbacin cewa Mijinnata yamutu kokuma ya aikomata cewa yasaketa, daga cikin Hujjojin Malaman dake kan wannan fahimta sunkafa Hujja da abin da aka ruwaito daga dukkan waɗannan Sahabbai:

(1)-Usman-Ɗan-Affan

(2)-Umar-Ɗan-Kaɗɗab,

(3)-Aliyu-Ɗan-Abi-Ɗalib,

(4)-Abdullahi-Ɗan-Abbas,

(5)-Abdullahi-Ɗan-Zubair

Cewa dukkansu sun yi hukunci ne akan cewa Mijin farko shi ne Mijinta, kuma ba'asamu wani Sahabi ko guda ɗaya da ya saɓamusu akan hakanba, Aʟʟαн(ﷻ) Yaƙara yarda agaresu baki ɗaya,

2. Ƙauli nabiyu kuma shi ne, Mazhabin MALIKIYYA suntafine akan cewa idan Mijinta nafarko ya dawo bayan Matar tagama iddarsa hartayi aure kuma Mijin yasadu da'ita, to ayanzu kam bashida iko a kanta tunda ta yi aure danhaka sukace Mutumin da ta aura nabiyun shi ne Mijinta, amma sukace idan baikai ga saduwa da'itaba to Mijita nafarko shi ne yafi cancanta da'ita.

Saidai magana mafi inganci anan ita ce, wannan Matar tana ƙarƙashin igiyar auren Mijintane nafarko da ya dawo, wannan kenan, to amma idan ya dawo yatarar har anriga anrabe dukiyarsa amatsayin gado to yanzu ya za'ayi kenan? Dukkan Mazhabobin nan guda huɗu sun yi ITTIFAƘINE akance za a dawomasa da dukiyar sane, to amma idan ya kasance dukiyar ta salwantafa ya zama babu ita tuni anriga ankasheta? Anan Sai Malamai suka yi Saɓani, mafi yawan Malamai sukace sai an rama masa anbiyashi dukiyarsa, amma Mazhabin HANAFIYYA sukace babu wata ramuwa da za'ayimasa, kawai abin da ya zo yasamu yakarɓa amma wanda yasalwanta kuma shikenan, Saidai magana mafi inganci idan wanda yaɓata kuma ya dawo gida to za'adawo masa da dukiyarsane dakuma Matarsa.

 وَالـلَّـهُ سُـبْـحَـانَـهُ=وَتـَعَــالـَيٰ أَعْـلَـمُ

ωαηαη sнιηε gωαяgωαdoη ɗαη αвιηdα ιℓιмιη мυ dαкυмα вιηcιкεηмυ үαкαι zυωα gαяεsнι, dαηнαкα ιdαη αηgα ωαηι кυsкυяε αcιкιη αвιηdα мυкα яυвυтα тo αηα'ιүα ғαɗαкαя dαмυ мυgүαяα, тαяεdα кαωo нυננα мαι ƙαяғι:

HUKUNCIN AUREN MATAR DA AKA ƊAUKI TSAWON LOKACI BA A SAN INDA MIJINTA YAKE BA

Tambaya

Mace ce mijinta ya ɓace, aka rasa labarinsa tsawon lokaci. Bayan ta yi idda, ta auri wani namiji, suka haifi ’ya’ya. Kwatsam sai ga mijinta na farko ya dawo.

A yanzu, matar waye a cikin mazan biyun?

Idan ya dawo ya tarar an raba dukiyarsa a matsayin gado, yaya hukuncin hakan?

Amsa

Na farko: Asalin ƙa’ida a Shari’a

A Musulunci, aure ba ya gushewa da shakku, kuma asalin aure yana nan har sai da tabbacin mutuwa ko saki.

Dalili daga Al-Qur’ani (Ka’idar Tsayuwar Aure)

﴿وَلَا تَنكِحُوا الْمُشْرِكَاتِ حَتَّىٰ يُؤْمِنَّ﴾

(Suratul Baqarah: 221)

Hausa:

“Kada ku auri mata mushrikai har sai sun yi imani.”

👉 Malamai sun yi istinbaɗi cewa aure abu ne mai tsanani a Shari’a, ba a rushe shi sai da hujja tabbatacciya.

1. Hukuncin matar idan mijinta na farko ya dawo

Ra’ayin mafi rinjaye (Jumhurul Fuqaha)

(Mazhabobin Hanafiyya, Shafi’iyya, Hanabila)

👉 Mijin farko shi ne mijinta na gaskiya.

Saboda:

Asalin aure yana nan

Bacewa ba mutuwa ba ce

Auren da aka yi mata da mijin na biyu:

Aure ne na shubuha

Ba a kiran shi zina ba

Hujja daga Sahabbai (Ijma’i na Aiki)

An ruwaito wannan hukunci daga:

Umar bn Khattab

Aliyu bn Abi Talib

Usman bn Affan

Abdullahi bn Abbas

Abdullahi bn Zubair

(Radiyallahu anhum ajma’in)

👉 Ba a san wani Sahabi da ya saɓa musu ba, hakan ya nuna ƙarfi da ingancin wannan ra’ayi.

Dalili daga Hadisi (Ka’idar Shubuha)

﴿ادْرَءُوا الْحُدُودَ بِالشُّبُهَاتِ﴾

(Hadisi Hasan, Tirmidhi da wasu)

Hausa:

“Ku kawar da hukuncin haddi idan akwai shakku.”

👉 Saboda shakku (mijin ya ɓace), ’ya’yan da aka haifa daga mijin na biyu halal ne, ana jingina su gare shi.

Abubuwan da suka biyo baya:

✔️ Matar za ta yi iddar mijin na biyu

✔️ Bayan idda, za ta koma wajen mijin na farko

Ba sai an sake ɗaurin aure ba, domin aurensu na farko yana nan

2. Ra’ayin Mazhabin Malikiyya (Ƙasa da rinjaye)

Malikiyya sun ce:

Idan mijin na biyu ya sadu da ita, to shi ne mijinta

Idan ba a sadu ba, to mijin na farko ya fi cancanta

👉 Amma wannan ra’ayi ba shi ne mafi ƙarfi ba idan aka auna da:

Ayyukan Sahabbai

Ka’idar tsayuwar aure

3. Hukuncin ’ya’yan da aka haifa

Dalili daga Hadisi

﴿الْوَلَدُ لِلْفِرَاشِ﴾

(Sahih Bukhari: 2053, Sahih Muslim: 1457)

Hausa:

“Yaro na wanda ake auren matarsa (mijin da aka aure).”

👉 Don haka:

’Ya’yan na mijin na biyu ne

Za su gaje shi, shi ma zai gaje su

Ba a jingina su ga mijin farko ba

4. Hukuncin dukiyar da aka raba a matsayin gado

Ijma’in Malamai

Dukkan mazhabobi huɗu sun yi ittifaqi cewa:

👉 Idan mijin ya dawo da rai, gadon ya rushe

Saboda rayayye ba ya gadon kansa.

Dalili daga Al-Qur’ani

﴿وَلَا تَأْكُلُوا أَمْوَالَكُم بَيْنَكُم بِالْبَاطِلِ﴾

(Suratun Nisa’i: 29)

Hausa:

“Kada ku ci dukiyoyinku a tsakaninku ta hanyar da ba ta dace ba.”

👉 Dukiyar dole ne:

A mayar masa idan tana nan

Ko a rama masa idan an salwantar da ita

Saɓanin malamai idan dukiyar ta ɓace

Jumhuri: a rama masa

Hanafiyya: abin da ya samu ya samu, wanda ya ɓace ya ɓace

👉 Mafi rinjaye: a rama masa gwargwadon iko.

5. Kammalawa (Taƙaitaccen Hukunci)

Matar ta mijin farko ce idan ya dawo da rai

Auren mijin na biyu na shubuha ne, ba zina ba

’Ya’yan da aka haifa na mijin na biyu ne

Dukiyar da aka raba a mayar wa mijin na farko

⚠️ Wannan mas’ala tana buƙatar hukuncin alkali a aikace

Wallāhu A‘lam.
